Terms of Participation and Privacy Notice

These Terms of Participation and Privacy Notice (hereinafter collectively referred to as the “Terms of Participation”) apply to participation in the giveaways organized by Spire of Completion (hereinafter referred to as the “Organizer”) and announced in connection with these Terms of Participation.

The Terms of Participation contain conditions, including rules for participation, and information on the processing of participants’ data and their rights of objection.

1. Reference to the Announcement of the Giveaway

Details on the conditions for participation, actions to be taken, the duration of the giveaway, and prizes are provided to the participants within the context of the giveaway.

In the event of any inconsistency, the information contained in the giveaway announcement shall prevail over these Terms of Participation.

2. Definition of the Term “Content”

For the purposes of these Terms of Participation, “Content” means any information submitted by participants in connection with the giveaway.

3. Age Restriction

Participation is possible only for persons who have reached the age of 18 and are legally permitted to participate in giveaways under the laws applicable in their respective country of residence.

4. Territorial Restriction

Participation is possible worldwide.

5. Further Criteria for Eligibility

Participation in the giveaway is limited to persons who follow, join, or subscribe to the online platform account, group, or curator specified in the respective giveaway announcement. No purchase or payment is required to participate.

6. Information on Prizes

The prizes of the giveaway consist of digital games. Details are specified in the respective giveaway announcement.

The winners will be randomly selected from all eligible participants.

7. Further Information on Prizes

The prizes are not transferable. A cash payment or exchange of the prizes is not possible.

If the prize is subject to regional restrictions or cannot be sent to or activated in the respective winner’s region, the Organizer may provide an equivalent digital alternative or draw a different winner to receive the prize.

8. Participants’ Responsibility

The Organizer is not responsible for the behaviour and the Content published by the participants within the context of the giveaway and does not adopt it as its own. Furthermore, the Organizer is not obliged to review the Content, but reserves the right to remove it if there are sufficient indications that the Content violates legal requirements, official prohibitions, the rights of third parties, or morality.

The Organizer may, at any time and without notice, exclude any participant who uses multiple online platform accounts to increase their chances of winning or who violates these Terms of Participation or the law from participating in the giveaway, subject to reasonable criteria.

Participants must ensure that they have the necessary rights to use the Content for participation in this giveaway and that its use does not violate legal regulations, morality, or the rights of third parties.

9. Mention of the Winners

The usernames of the winners may be publicly announced in connection with the giveaway by the Organizer. Participants may object to this at any time with effect for the future.

10. Giveaways within Online Platforms

If the giveaway takes place within an online platform, the following provisions apply additionally.

Participants may not assert any claims against the online platform arising in connection with participation in and use of the giveaway. Participants acknowledge that the giveaway is in no way sponsored, supported, or organised by the online platform, nor is it connected to the online platform in any way. All personal data processed by the Organizer in the context of the giveaway will be used solely for the purposes of conducting the giveaway and not for any other purposes. The Organizer kindly asks you to address all enquiries and comments regarding the giveaway to the Organizer and not to the online platform.

In addition to these Terms of Participation, the applicable terms and conditions and data protection information of the online platform shall apply in relation to the online platform. Further information on the consents given and the possibility to revoke such consents can be found in the data protection information of the online platform.

11. Information on Warranty and Liability

The Organizer points out that the giveaway and the prizes are voluntary services which are not subject to the same scope of guarantee and liability as, for example, the purchase of such prizes independent of the giveaway.

The prizes of the giveaway consist of digital games. The Organizer shall not be liable for the availability, functionality, or compatibility of the games. In all other respects, the terms and conditions of the respective provider shall apply.

There is no legal recourse with regard to the drawing of the winners, except in cases of intent or gross negligence.

12. Privacy Information

The Organizer processes the personal data (also referred to as “data”) of participants only in compliance with applicable data protection regulations and where such processing is necessary for the execution of the giveaway (Article 6 (1) (b) GDPR), where participants have consented to the processing (Article 6 (1) (a) GDPR), or where the processing serves the Organizer’s legitimate interests in the security of the giveaway or the protection of the Organizer’s interests against misuse of the giveaway pursuant to Article 6 (1) (f) GDPR.

For the purpose of conducting the giveaway and selecting the winners, only the publicly visible usernames on the respective online platform are processed.

The usernames of the winners may be publicly announced in the context of the giveaway, including by posting a comment under the giveaway post on the respective online platform. Participants may object to this at any time with effect for the future.

As data subject, you are entitled to various rights under the GDPR, which arise in particular from Articles 15 to 21 of the GDPR:

  • Right to Object: You have the right, on grounds arising from your particular situation, to object at any time to the processing of your personal data which is based on Article 6(1)(f) GDPR.
  • Right of Withdrawal for Consents: You have the right to revoke consents at any time.
  • Right of Access: You have the right to request confirmation as to whether the data in question will be processed and to be informed of this data and to receive further information and a copy of the data in accordance with the provisions of the law.
  • Right to Rectification: You have the right, in accordance with the law, to request the completion of the data concerning you or the rectification of the incorrect data concerning you.
  • Right to Erasure and Right to Restriction of Processing: In accordance with the statutory provisions, you have the right to demand that the relevant data be erased immediately or, alternatively, to demand that the processing of the data be restricted in accordance with the statutory provisions.
  • Right to Data Portability: You have the right to receive data concerning you which you have provided to the Organizer in a structured, commonly used and machine-readable format in accordance with the legal requirements, or to request its transmission to another controller.
  • Complaint to the Supervisory Authority: You also have the right, under the conditions laid down by law, to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.
